Can my partner work while we wait?

Whether your partner can work while you wait depends entirely on which visa they hold or have applied for. A partnership work visa generally comes with open work rights, meaning your partner can work for almost any employer. A partnership visitor visa does not allow work at all. While an application is being processed, an interim visa may apply with its own conditions. Working without the right to work is a serious breach that can damage future applications.

It depends on the visa

There is no single answer because partnership covers different visa types with very different work conditions. The key question is always which visa your partner currently holds, and which one they have applied for. Check the conditions stated on the visa itself, as those conditions - not assumptions - decide what your partner is legally allowed to do.

Work visa versus visitor visa

The practical difference is stark, so it's worth being clear about each:

  • A partnership work visa usually grants open work rights, allowing your partner to work for most employers without a separate job offer.
  • A partnership visitor visa does not permit work; it is for visiting and being with you, not for employment.
  • Always confirm the exact conditions printed on the visa, as individual grants can carry specific restrictions.

What about while the application is processing

If your partner is already in New Zealand on a valid visa and applies for a new one before it expires, they may be granted an interim visa to stay lawfully while the application is decided. An interim visa carries its own conditions, which may or may not include the right to work, and they don't automatically match the visa being applied for. Never assume an interim visa allows work - check the conditions you're given.

Why working without the right to work is serious

Working in breach of visa conditions is not a minor issue. It can lead to the current application being declined, affect your partner's lawful status, and count against future visa and residence applications. If there is any doubt about whether your partner may work, the safe course is to confirm the conditions or seek advice before they start - not after.

Common questions

My partner applied for a partnership work visa. Can they work right away?
Not necessarily. Work rights begin when a work visa with open work conditions is granted, not simply when the application is lodged. If they're on an interim visa while waiting, they can only work if that interim visa specifically allows it, so check its conditions.
Can my partner work on a partnership visitor visa?
No. A visitor visa does not allow employment. If your partner needs to work, the appropriate pathway is a partnership work visa, which generally carries open work rights once granted.
What counts as working without the right to work?
Doing paid (and sometimes unpaid) work that the visa conditions don't allow, including starting before a work visa is granted or working on a visitor or interim visa that has no work rights. It's a serious breach, so confirm the conditions first.
