Can I include my children in a partnership visa application?
Party A is in a genuine relationship with Party B, a New Zealand citizen or resident, and is preparing a partnership-based visa application. Party A also has dependent children from a previous relationship and wants them to come to New Zealand as a family. Party A is unsure whether the children can be added to the same application and what evidence is needed.
In many cases yes: dependent children can be included with a partnership-based application, but they are assessed against their own requirements, not added automatically. Generally the child must be genuinely dependent on you, within the relevant age range, and you must show your parental relationship.
You will usually need evidence for each child:
- Birth certificates showing the parental link.
- Where custody is shared, consent from the other parent to bring the child to New Zealand.
The exact requirements and which visa the children apply for depend on the parent's visa category. Because children's applications raise extra questions around custody and dependency, get tailored advice, MyLaw can help you include them correctly and avoid delays. See how to apply.
